Lawsuits Against Trustees and Personal Representatives

Under Michigan law, trustees, personal representatives, and guardians and conservators have what is known as a fiduciary duty to beneficiaries. This means they have a responsibility to act loyally to beneficiaries and other people who are supposed to benefit from a will or trust. Sometimes a person with a fiduciary duty behaves improperly. For example, they may fail to do proper accounting. Or they may self-deal or improperly convert estate assets. If this happens, I can help you take legal action requiring the person right the wrong, for example, by correcting accounting mistakes or paying back money wrongfully taken.
